Legal issues of real – estate developers: The case of Ashton Asoke
Abstract
Legal issues for real estate developers: The case of Ashton Asoke was to critically examine the decisions made by the Central Administrative Court and the Supreme Administrative Court, which resulted in the revocation of all permission documents pertaining to the Ashton Asoke condominium. It led to the demolition of the building with a total of 265 residential units due to a lack of at least a 12-meter-long entrance and exit connected to a public road. The ramifications of the verdict extended to other real estate developers who had a similar approach to Ashton Asoke, encompassing a minimum of 100 cases. To prevent the demolition of the project, it is imperative for the developers to possess a comprehensive understanding of the regulations and any alterations in the circumstances inside the public agency.

Loss of Inheritance Rights due to Being Excluded from the Succession: A Comparative Study between Thai Legislation and The Laos People’s Democratic Republic’s law
Abstract
This paper aims to study the loss of inheritance rights because the heir is legally excluded from receiving inheritance under Thai law in comparison with legislation of the Laos People's Democratic Republic (Loas).
The study found that both Thai law and Laos’s law contain provisions regarding the loss of heirs' inheritance rights. The heir may be precluded from succession before or after the death of the owner of the inheritance because he/she is illegally engaged in moving and concealing the existence of property, which are the encroachment on the inheritance property. Exclusion from succession could involve the commission of any act against the owner of the inheritance and other descendants. Based on the law of Laos, it contains border provisions that exclude the right to inheritance than Thai law. The provisions preclude heir who have been convicted of unlawfully intending or attempting to cause the death of the owner of the inheritance or other heirs, which is a crime against life. These models are comparable to Thai law. Laos's law also covers the heir who causes serious harm to the owner of the inheritance, as well as when an heir conceals or supports such an offense. The person may lose the right to inheritance when he/she is judged to fail to perform the duty of care and support the owner of the inheritance as parents and children. The law of Laos also excludes the heir who resides in the same province or city as the owner of the inheritance, but he/she did not arrange a funeral or assign another person to act on his/her behalf. These actions result in losing inheritance rights, which do not appear in Thai law.
Therefore, the paper suggests to revise Thai legislation concerning exclusion from succession because the heir committed an offense leading to a final judgment that he/she intended to commit or attempted to unlawfully cause the death of the owner of the inheritance or the person who could inherit before him/her unlawfully. It is essential to specify the heir's actions as "instigator" or "supporter". The legal model of Laos should be applied to Thai law to preclude the heir who intentionally ignores the legal duty to care for parent, this factor should be taken as another cause of the loss of inheritance rights.

Maternity leave and breaks during work for breastfeeding of female employees according to Thai labor protection laws: A comparative study of international labor standards and foreign laws
Abstract
This research has the objective to: 1. Study the concept of maternity leave and break during work for breastfeeding of the female employee; 2. Study and comparatively analyze the maternity leave and breaks during work for breastfeeding of female employee under Thai labour protection law, international labour standard and foreign laws; 3. Propose the appropriate guideline to amend and revise maternity leave and break during work for breastfeeding of female employee under Thai labour protection law by the Qualitative Research by means of the Documentary Research. The research’s result is that Thai Labour Protection Act B.E. 2541 (1998) allows female employee to be entitled to maternity leave of not more than 98 days per each pregnancy, which has not the period of maternity leave in case of having at least 2 children at a time and has not stipulated that the employer must provide the break for breastfeeding of female employee with paid. This is neither in compliance with the international labour standard nor foreign law which allows them to take additional maternity leave days if she has a pregnancy of at least 2 children and the employer gives the female employee with child under 1 year upon request to take a break for breastfeeding of 30 minutes or more for 2 times per days with paid during such period. Thai female employees have not been appropriately protected regarding maternity leave. Therefore, Thai Labour Protection Act B.E. 2541 (1998) should be amended to increase the maternity leave days for female employee who has 2 children in one pregnancy and employer to enable the female employee who has children to take a break for breastfeeding so that their children will be breastfed for a reasonable period.
